Kararda; daval\u0131 booking.com\u2019un haks\u0131z rekabete neden oldu\u011fu, dijital ve sabit i\u015f yeri a\u00e7ma yoluyla sitenin faaliyetlerinin \u201cseyahat acenteli\u011fi\u201d oldu\u011fu, T\u00fcrkiye Cumhuriyeti\u2019ne vergi \u00f6demedi\u011fi, i\u015f hukuku \u015fartlar\u0131na uygun hareket etmeyerek, i\u015f yeri a\u00e7mak i\u00e7in gerekli izinleri almad\u0131\u011f\u0131, idari ve hukuki denetimlerden ka\u00e7\u0131nd\u0131\u011f\u0131 belirtildi. \r<br>\r<br>Mahkeme taraf\u0131ndan belirlenen haks\u0131z rekabete neden olan unsurlar\u0131n giderilmesi ve 500 bin lira teminat\u0131n yat\u0131r\u0131lmas\u0131 kar\u015f\u0131l\u0131\u011f\u0131nda booking.com\u2019a eri\u015fimin engellenmesi y\u00f6n\u00fcndeki tedbirin kald\u0131r\u0131lmas\u0131na karar verildi.\r<br>\r<br>Haks\u0131z rekabet karar\u0131n\u0131 de\u011ferlendiren T\u00dcRSAB Ba\u015fkan\u0131 Firuz B. Ba\u011fl\u0131kaya, \u201cBiz s\u00f6z konusu portal\u0131n belgesiz, vergi vermeden \u00fclkemizde seyahat acentac\u0131l\u0131\u011f\u0131 faaliyeti yapmas\u0131na itiraz etmi\u015ftik. Mahkeme, bak\u0131\u015f a\u00e7\u0131m\u0131zda hakl\u0131 oldu\u011fumuz y\u00f6n\u00fcnde net bir karar verdi. Hakl\u0131l\u0131\u011f\u0131m\u0131z tescillenmi\u015f oldu. Karar bu y\u00f6nden di\u011fer yabanc\u0131 men\u015feli firmalar i\u00e7in de emsal niteli\u011fi ta\u015f\u0131yor\u201d dedi.
